Terms and Conditions and General Booking Conditions – Casa Espalamaca

1 – Introduction

These Terms and Conditions (hereinafter “Terms”) regulate access to and use of the website https://casa-espalamaca.pt(hereinafter “Site”), as well as the services provided by Junge Ventures, Unipessoal, Lda, NIF 515705160, headquartered in Rua da Conceição, 17C, 9900-080 Azores – Horta, Portugal, AL License No. RRAL 5231(hereinafter “Casa Espalamaca”).
By accessing or using the Site, you acknowledge that you have read, understood and accepted these Terms, as well as the Privacy Policy and General Booking Conditions.


2 – Obligations and general responsibilities of the user

Casa Espalamaca reserves the right to amend these Terms at any time by posting the changes on the Site. It is the user’s responsibility to check and comply with the latest version each time they access the Site. Continued use of the Site constitutes acceptance of the updated Terms.

Users agree to comply with these Terms on their own behalf or on behalf of the entity they represent. Access to the Site through automated means (scripts, crawlers, etc.) or for illegal or harmful purposes is strictly prohibited.


3 – Rights and obligations of Casa Espalamaca

Casa Espalamaca may:

  • Modify, add or remove parts of the Terms at any time;

  • Modify or terminate services without prior notice;

  • Remove user accounts with content that is illegal, offensive, defamatory, pornographic, or violates intellectual property rights;

  • Suspend or discontinue services partially or entirely.

Technical support is available only via email for registered users.


4 – Intellectual property and personal rights

Ownership

All information, data, text, software, audio, video, and images on the Site are the property of Casa Espalamaca or third parties. Users may not copy, rent, lend, sell, distribute or create derivative works without written permission.

Trademarks

Users are not allowed to use any trademarks, logos, domain names, or other distinctive brand elements without express written authorization.

Software

Casa Espalamaca grants users a non-exclusive, worldwide, personal, and non-transferable license to use the booking interface software solely to use the booking services as permitted by these Terms. Users may not copy, modify, reverse engineer, or sublicense the software unless expressly authorized.


5 – Disclaimer of warranties

Services are provided “as is” and “as available.” Casa Espalamaca makes no guarantees that services will meet user expectations, be uninterrupted, secure, error-free, or that software defects will be corrected. Users assume full responsibility and risk for using the Site and services.


6 – Limitation of liability

Casa Espalamaca is not liable for:

  • Users’ judgments regarding advertisers;

  • Changes to or suspension of services;

  • Loss or corruption of data;

  • Breach of Terms;

  • Security breaches of passwords or account details.

Liability is limited to cases of willful misconduct or gross negligence.


7 – Privacy Policy

The Privacy Policy is available at https://casa-espalamaca-pt/privacy-policy/. Casa Espalamaca collects and processes personal data in accordance with this policy.


8 – General provisions

  • Prevalence: Specific provisions prevail over general Terms in case of conflict.

  • Rights exercise: Failure to exercise rights does not constitute a waiver.

  • Entire Agreement: These Terms constitute the full agreement with users.

  • Severability: Invalid provisions do not affect the validity of others.

  • Notifications: Preferably via email or the user’s registered address.


9 – General Booking Conditions

9.1 Scope

These General Conditions govern the provision of tourist accommodation booking services and additional tourist services provided by Casa Espalamaca through the Site. By completing the booking form, the Client accepts these General Conditions as well as the Terms and Conditions and Privacy Policy of the Site.

9.2 Reservations

The Client must provide accurate information, including dates, tariffs, personal data, and payment details. Confirmation of the booking grants a booking code, which must be referenced in all communications with Casa Espalamaca.

9.3 Benefits, promotions and discounts

Benefits, promotions, and discounts are subject to availability, validity, and applicable rules. Fraudulent use may result in cancellation or application of standard rates.

9.4 Taxes

Prices include VAT and other legally required taxes.

9.5 Fees

Reservation, amendment, or cancellation fees may apply and will be charged at the time of booking.

9.6 Amendments

Booking amendments require Casa Espalamaca’s agreement and may affect the price. Cession of a booking requires written notice at least 7 days prior to arrival.

9.7 Accommodation

Accommodation characteristics correspond to the booking. Differences from photos do not entitle the Client to modify the contract. Check-in from 16:00; check-out before 11:00.

9.8 Cancellation

Cancellation Policy (Flexible Rate)

All reservations are made under a Flexible (Refundable) Rate:

Free Cancellation

Guests may cancel free of charge up to 30 days before arrival, receiving a full refund (100%).

Late Cancellation

Cancellations made within 30 days prior to arrival will be charged 100% of the total reservation amount.

No-Show

In case of no-show, 100% of the reservation amount will be retained.


Payment Policy

  • A 100% prepayment is required at the time of booking to confirm the reservation.
  • The reservation remains fully refundable if cancelled more than 30 days before arrival.
  • Within 30 days of arrival, the booking becomes non-refundable.

Refunds will be processed using the same payment method whenever possible, within a reasonable timeframe.

Casa Espalamaca reserves the right to cancel the reservation if payment is not successfully completed.


Changes to Reservation
  • Changes requested more than 30 days before arrival may be accepted, subject to availability and rate adjustments.
  • Changes requested within 30 days prior to arrival will be treated as a cancellation.

 

9.9 Impossibility of performance

Casa Espalamaca is not liable for non-performance due to force majeure or circumstances beyond its control.

9.10 Complaints

Complaints must be submitted in writing within 20 days after the end of the service. Relevant supporting documents are required.

9.11 Liability

Casa Espalamaca is not responsible for theft, loss, or damage to the Client’s personal belongings.

9.12 Personal data

Personal data are processed in accordance with the Privacy Policy.

9.14 General provisions

General Conditions may be amended at any time by Casa Espalamaca for future bookings; amendments take effect immediately.

9.15 Governing law and jurisdiction

Portuguese law applies. Courts of Lisbon have exclusive jurisdiction.

9.16 Acceptance

Booking confirms full acceptance of these General Conditions.

9.17 Entry into force

These General Conditions enter into force on October 1, 2025 and replace all previous versions.

9.18 Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may use the European Online Dispute Resolution (ODR) Platform at http://ec.europa.eu/consumers/odr or the following entities in Portugal:
